Lawyer Says Michael Madsen Didn't Fail Sobriety Test

Soon after Michael Madsen was arrested on suspicion of DUI, his lawyer Perry Wander set the record straight. In a statement to TMZ, the attorney claimed his client did not fail the field sobriety test and believed "that the breathalyzer test is flawed."

The "Kill Bill" actor was pulled over by LAPD police officer for driving his red GTO recklessly on Malibu's Pacific Coast Highway on Wednesday afternoon, September 12. The 54-year-old star was detained after allegedly failing sobriety test.

At the time of arrest, his blood-alcohol level reportedly was .21 percent, almost three times the legal limit (.08). The "Reservoir Dogs" actor was later taken to a nearby hospital after complaining of pain during his stay at the Lost Hills-Malibu Station.

His bail was set at $15,000, but he reportedly has been released because police believed he wasn't the type to flee. "It's a misdemeanor," said Steve Whitmore from the Los Angeles County Sheriff's Department. "We know where he lives."
